To celebrate this momentous year, Kentucky State University is giving you a chance to win a new 2021 Toyota Camry. Raffle sales will begin in April 2021. To purchase your raffle ticket, contact advancement@kysu.edu.

PARTICIPANT AGREEMENT: By purchasing a raffle ticket the purchaser agrees to be bound by these rules and regulations. Kentucky State University’s (KSU) interpretation and application of these rules and regulations shall be final. The raffle is subject to all applicable federal, state and local laws.

Each raffle participant accepts and agrees that their names and/or likenesses may be disclosed and used by KSU, including a release to news media or internet publication of the official winner.

Each participant releases KSU from any and all liability for injuries, losses or damages of any kind caused by participation in the raffle or resulting from acceptance, transfer, ownership, use or misuse of the prize, and the winner agrees to indemnify and hold KSU harmless from any and all losses, damages, rights, claims and actions of any kind rising in connection with or as a result of participation in the raffle or the winner’s acceptance or use of the prize.

Each participant’s sole and exclusive remedy for any unanticipated breach by KSU shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall KSU be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.

NET PROCEEDS: All net proceeds of the Raffle will be used to support students at Kentucky State University, the Raffle prize, and university infrastructure and expansion.

ELIGIBILITY TO ENTER: During the entry period specified below, raffle tickets may be purchased in accordance with these Official Rules on KYSU.EDU/TogetherThorobreds135. Raffle tickets may be purchased only by individuals who are 18 years of age or older with a valid driver’s license. The winner may be required to sign an affidavit of eligibility at the discretion of KSU.

The following persons are NOT ELIGIBLE to participate in the Raffle or to win any prize: the president of the University; University senior-level administrators; and, persons who do not/will not meet the age requirement at the time of drawing.

PURCHASING RAFFLE ENTRIES: The Raffle is open to the public. Tickets can be purchased between April 2021 and October 16, 2021, ending at noon. Individual tickets are $50 each. Multiple tickets can be purchased by an individual. The sale of raffle tickets through the internet may be suspended or stopped at any time at the sole discretion of KSU.

Any participant who engages in conduct designed to corrupt the outcome of a charitable activity with the purpose to defraud, or knowing that he or she is facilitating a fraud, is guilty of a Class D felony.

Only one method of payment, one name, and one mailing address are permitted per ticket. Division of Prize by a group purchasing a ticket in common shall be the sole responsibility of the person named as the holder of record of that ticket should that ticket be selected as a winner.

KSU reserves the right to reject any entry form that is submitted with payment that does not constitute “good funds.” KSU will make reasonable effort to notify individuals that submit an entry form which has been rejected because a credit card or check payment did not clear.

No refund will be made except under the following circumstances: any ticket order with payment received after the entry period ends will be returned. No other refunds are available except at the exclusive discretion of KSU.

KSU is not responsible for lost, late, misdirected or non-delivered mail, and any other failure to receive orders or deliver receipts prior to the drawing deadline.

PRIZE: The prize is a 2021 Toyota Camry; no cash option is available. The vehicle comes base model factory equipped with navigation and the winner is solely responsible for any and all state or local title, registration, or other fees associated with the vehicle, as well as insurance (proof of which must be shown prior to delivery) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the winner and negotiated with the dealership.

RETAIL VALUE: The approximate retail value is $20,000.

PRIZE AWARDED: Only one vehicle will be awarded. The vehicle will be transferred to the official winner “as is, where is, and with all faults”. KSU does not make or provide any representation, guarantee or warranty, expressed or implied, in connection with the vehicle and accepts no liability or responsibility regarding the construction or condition of the vehicle. KSU does not warrant that the car is of mercantile quality or that it can be used for any particular purpose.  No express warranties are given and no affirmation of KSU by words and/or actions will constitute a warranty. 

DRAWING DATE: A winner will be announced on October 16, 2021 during halftime at Homecoming 2021. Odds of winning depend on the total number of eligible entries received.

DETERMINATION OF OFFICIAL WINNER: KSU shall have the sole discretion to determine whether the potential winner is the official winner. KSU’s decision concerning the official winner shall be final and binding. To become an official winner, a potential winner must be eligible to participate in the raffle under these official rules and must not be in violation of these official rules as determined in KSU’s sole judgment.

The winning raffle cannot be assigned, transferred or sold. Prize will be titled in the official winner’s name only and cannot be changed.

TAXES AND FEES: The official winner of the prize shall assume all governmental fees and all local, state and federal taxes which must be paid on the prize, including any taxes or fees owed at the time of delivery, as well as all state or local title, registration, and other fees. KSU takes no responsibility for any tax liabilities, owner costs or transfer costs. 

KSU makes no guarantee that the Internal Revenue Service (IRS) will accept that value of the vehicle for the purpose of determining any income tax that may be due from the winner. KSU takes no responsibility for any tax liabilities. Consult your tax advisor.
